Le 08 mars 2022, nous adressons cette lettre ouverte adressée à Michèle Bachelet, Haute-Commissaire des Nations unies aux droits humains pour qu’elle publie sans tarder son rapport sur le Xinjiang.
Madame la Haute-Commissaire,
Nous, organisations de défense des droits humains soussignées, vous sollicitons au sujet de l’engagement pris l’année dernière de publier un rapport relatif aux violations graves des droits humains que les autorités chinoises continuent de commettre à l’encontre de la communauté ouïghoure et d’autres communautés turcophones dans la région autonome ouïghoure du Xinjiang (ci-après région ouïghoure). Il est primordial de publier ce rapport sans délai en vue de montrer aux victimes comme aux auteurs de violations qu’aucun État, quelle que soit sa puissance, ne saurait se soustraire au droit international et au contrôle indépendant rigoureux de votre Bureau.
Comme vous le savez, nombre des organisations signataires ont exposé comment les Ouïghours, les Kazakhs et d’autres groupes ethniques majoritairement musulmans dans la région ouïghoure sont confrontés de manière systématique à la détention, à la torture, à la persécution et à d’autres violations de leurs droits perpétrées à grande échelle par l’État. Par leur nature et leur ampleur, ces violations constituent des crimes contre l’humanité. À maintes reprises, nous avons tiré la sonnette d’alarme, en nous adressant notamment au Haut-Commissariat, en ce qui concerne les mesures extrêmes adoptées par les autorités chinoises depuis 2017 en vue d’éradiquer les traditions religieuses, les pratiques culturelles et les langues locales des groupes ethniques de confession musulmane dans la région. Perpétrés sous couvert de lutte contre le « terrorisme », ces crimes visent les Ouïghours, les Kazakhs, les Huis, les Kirghizes, les Ouzbeks et les Tadjiks.
En 2020, un nombre sans précédent de représentants des procédures spéciales ont publié une déclaration historique dans laquelle ils exprimaient leurs préoccupations concernant les violations des droits humains en Chine, et notamment dans la région ouïghoure, et appelaient les Nations unies à prendre des mesures décisives. Les organes de traité ont également fait état de leur préoccupation quant à la situation dans cette région au cours des cinq dernières années.
Nous sommes préoccupés de constater que par contraste, face à ces violations graves, le Haut-Commissariat maintient un silence relatif, se contentant de l’actualisation procédurale des informations relatives au statut des négociations visant à obtenir un véritable accès au Xinjiang, qui, selon vos déclarations, n’ont pas progressé. Dans ce contexte, nous avons accueilli favorablement votre déclaration de septembre dernier confirmant que le Haut-Commissariat était en voie de « finaliser son examen des informations disponibles sur des allégations de violations graves des droits humains au [Xinjiang] en vue de le rendre public ». Six mois se sont écoulés et bien qu’en décembre votre porte-parole ait affirmé que la publication du rapport n’était plus qu’une question de semaines, celle-ci n’a toujours pas eu lieu à ce jour.
Les victimes ne devraient pas avoir à attendre davantage. Elles méritent, ainsi que leurs familles, d’obtenir la justice et de voir les responsabilités établies et elles ont besoin de savoir qu’elles peuvent compter sur le Haut-Commissariat.
Nous vous exhortons à remplir votre mandat en publiant ce rapport sans délai et en informant de manière urgente les États membres et observateurs du Conseil des droits de l’homme des Nations unies de son contenu.
L’obligation de rendre des comptes doit prévaloir dès à présent.
